This is the Privacy Policy of I BID ON Pty Ltd (ACN 620 741 657) as The Trustee for IBOS Auction Trust and trading as I BID ON STORAGE (collectively, iBidOnStorage, we, our and/or us).
At iBidOnStorage, we are committed to safeguarding your privacy and protecting your personal information. This document contains important information about how we manage your personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles which are contained in the Privacy Act.
Specifically, this document includes information about:
(a) the kinds of personal information that we collect and hold;
(b) how we collect and hold personal information;
(c) the purposes for which we collect, hold, use and disclose personal information;
(d) how you may access personal information about you that is held by us and seek the correction of such information;
(e) how you may complain about a breach of the Privacy Act or the way in which we have managed your personal information, and how we will deal with such a complaint;
(f) whether we are likely to disclose personal information to overseas recipients and where such recipients are located; and
(g) our contact details.

2. Changes to this policy
We may update our Privacy Policy from time to time by either notifying you of a change to the policy and providing you with a link to the updated policy or by publishing a new version on our website without notice. By continuing to use our website or otherwise continuing to deal with us, you accept this policy as it applies from time to time.
If we make any material changes to the way we use your personal information, we will notify you by sending you an email to the last email address you provided to us (if any) and/or by posting notice of the changes on the website.
3. What is personal information?
Personal information is defined in the Privacy Act as any information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion:
(a) is true or not; and
(b) is recorded in a material form or not.
Common examples are an individual’s name, signature, address, telephone number, date of birth, medical records, bank account details, employment details and commentary or opinion about a person. What constitutes personal information will vary, depending on whether an individual can be identified or is reasonably identifiable in the particular circumstances.
4. What kinds of personal information do we collect and hold?
The kinds of personal information that we collect and hold may include details such as your:
(a) identity (your name);
(b) date of birth (you need to be aged 18 years or over to use the iBidOnStorage auction platform);
(c) contact information (your home address, email address and telephone number); and
(d) financial information (your credit card details).
5. Collection of personal information
The ways in which we collect personal information can be broadly categorised into information that:
(a) you provide to us directly;
(b) we collect automatically; and/or
(c) we obtain from third parties.
We usually collect personal information directly from you. For example, we may collect personal information from you when you complete and submit a form on our website (including to contact us or to register as an iBidOnStorage user), during telephone calls or when you correspond with us via email.
Sometimes we collect this information or confirm this information with a third party. We will use reasonable efforts to obtain your consent prior to contacting a third party for this purpose.
When you visit our website or use other web-based content and services of ours (including the iBidOnStorage auction platform) we or our service provider(s) will collect information about:
(a) your use of our services, including your login details, IP address, behavioural data, activity logs and information collected by cookies (for further details about our use of cookies, please see section 12 below);
(b) the devices you use to access our services including the device type, operating systems, browsers, application settings and location information;
(c) the way you use your devices when accessing our services; and
(d) the applications and software installed on your devices, to help identify applications and software such as bots, malware and remote access threat applications.
Sometimes this information will include your personal information.
6. Sensitive information
Sensitive information is personal information that includes information or an opinion about an individual’s:
(a) racial or ethnic origin;
(b) political opinions or associations;
(c) religious or philosophical beliefs;
(d) trade union membership or associations;
(e) sexual orientation or practices;
(f) criminal record;
(g) health or genetic information; and
(h) some aspects of biometric information.
Generally, sensitive information has a higher level of privacy protection than other personal information. If we collect any information from you that is sensitive information, we will first obtain your consent. We will not use or disclose your sensitive information for any purpose other than the primary purpose for which your sensitive information was collected, unless you expressly consent for us to do so.
7. Use and disclosure of personal information
(a) How we use your personal information
We use your personal information for various reasons, including to:
· provide you with a product or service that you’ve requested;
· manage our relationship and to communicate with you;
· comply with any legal or regulatory obligations imposed on us;
· provide you with technical support or respond to customer service inquiries;
· enhance our website and products and services and develop new ones;
· identify and prevent any fraudulent, malicious or other unauthorised activity;
· resolve disputes;
· make sure that everyone is using our website in accordance with our Website Terms;
· make sure that auction participants and sellers are using our services safely and fairly and in accordance with the iBidOnStorage Terms and Conditions;
· send you marketing communications about our products and services;
· produce aggregated and anonymised analytics and reports which we may share publicly or with third parties; and
· help you to communicate with your trading partners.
Under no circumstances will we sell your personal information to third parties.
If you have registered as an iBidOnStorage user, you will be identified on the auction platform by the username that you have chosen. This means that other users can view your trading activity, including in relation to items that:
· you are bidding on;
· you have won; and
· you are currently selling.
Your trading partners (other users with whom you have completed a transaction) may request to exchange personal details and contact information with you (for example, your name, home address, email address and telephone number). If you choose to share your personal details and contact information with other users, you do so at your own risk and we accept no liability for any loss, injury or damage you may suffer as a result.
(b) Disclosure of your personal information
We may disclose your personal information to an individual or an organisation (including a regulator or government authority) as required or contemplated by law.
We may also disclose your personal information to an individual or an organisation (a third party) if you:
· direct us to do so;
· consent to the third party obtaining the information from us; or
· consent to the third party accessing the information on our systems, and/or do anything which enables the third party to obtain access.
Your consent to a third party obtaining or accessing information may be implied from:
· your use of any service or application which a third party provides to you, or makes available to you, which involves the third party obtaining or accessing personal information held by us or organisations like us; or
· you doing anything else which enables the third party to obtain access to the information.
(c) Disclosure to overseas recipients
In some cases we may need to share some of your information with organisations outside Australia or Australian organisations that store data or operate outside of Australia (for example, when we use service providers located in Australia or overseas to perform a function on our behalf).
If and when we share your information with organisations overseas, we seek to ensure that appropriate data handling and security measures are in place. We may share your information with overseas organisations that are located in the United States.
8. Storage and security of your personal information
We will take reasonable steps (including by adhering to standard industry practices where possible) to keep the personal information we hold about you secure and to ensure that it is protected from misuse, interference, loss, unauthorised access, modification or disclosure.
We use a variety of physical and electronic security measures including restricting physical access to our offices, firewalls and secure databases to keep personal information secure.
Due to technical limitations, we cannot and do not guarantee that your personal information will remain private as third parties may unlawfully intercept or access private communications and transmissions outside the iBidOnStorage auction platform environment.
Our employees and contractors who provide services related to our information technology systems are obliged to respect the confidentiality and privacy of any personal information we hold. However, we will not be held responsible for events arising from unauthorised access to your personal information.
You can help to keep the personal information we hold about you secure by taking care before you authorise or otherwise assist any third party to obtain or gain access to that information.
9. Requests for access to and correction of your personal information
In most cases, you can access your personal information held by us. If you believe that personal information we hold about you is inaccurate, out of date or incomplete, please contact us at [email protected] and we will take prompt and reasonable steps to ensure that it is corrected.
In some cases we may request that you provide us with supporting documentation to amend the personal information we hold about you. If we do not agree that your information is inaccurate, out of date or incomplete, we will give you a written notice which will include the reasons why we do not agree with you and how you can make a complaint if you wish to do so.
10. Retention and deletion of your personal information
You may request deletion of your personal information by us at any time. However, we may be required under the Privacy Act to keep this information and not delete it (or to keep this information for a certain time) in which case we will comply with your deletion request only after we have fulfilled such requirements.
Once we are no longer required to keep your personal information and the primary purpose for which your personal information is no longer relevant (for example, you cancel your user registration) we will take reasonable steps to destroy or permanently de-identify the information as appropriate.
When we delete any information, it may remain in our archives. We may retain your information for fraud or similar purposes if this is permitted or required under the Privacy Act. However, if we have already disclosed some of your personal Information to third parties, we cannot access that personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures. In that situation, you would need to approach those third parties directly.
11. Opting out of direct marketing
If you do not wish to receive our marketing communications, you may opt out of these communications by:
(a) contacting us;
(b) clicking the unsubscribe link included at the end of every promotional message; or
(c) managing your communication preferences via your online account profile.
If you do choose to opt out, we will continue to provide information in relation to your existing products or services only, including new features.
A cookie is a piece of data stored on a user’s computer which is tied to information about the user. Cookies typically store unique identifiers or anonymous user IDs, which can be used to track a user`s activity on a website but don`t directly reveal the user`s name, address, or other personal details.
Most internet browsers are set up to accept cookies. If you do not wish to receive cookies, you may be able to change the settings of your browser to either refuse all cookies or notify you each time a cookie is sent to your computer, giving you the choice whether to accept it or not.
We use session ID cookies to make it easier for you to navigate our website. Once a user closes the browser, the session ID cookie simply terminates.
A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. Persistent cookies can be removed by following the relevant internet browser help directions. As at the date of this policy, we do not currently use persistent cookies.
13. Notifiable data breaches
Under the Notifiable Data Breach Scheme, we are required to notify particular individuals and the Office of the Australian Information Commissioner (OAIC) about eligible data breaches.
Not all data breaches are eligible. For example, if we act quickly to remediate a data breach and, as a result of this action the data breach is not likely to result in serious harm, there is no requirement to notify any individuals or the OAIC.
Whether a data breach is likely to result in serious harm (which is one of the criteria of an eligible data breach) requires an objective assessment, determined from the viewpoint of a reasonable person in our position.
14. Feedback and complaints
(a) Feedback
We welcome ideas and feedback about all aspects of our services (including the iBidOnStorage auction platform) and/or our website. We store all feedback provided by users and use this feedback to administer and refine our services and/or the website. Any feedback shared with our partners or service providers will only be shared in aggregate form or with identifying characteristics removed.
(b) Complaints
If you wish to make a complaint about the handling of your personal information, please contact our Privacy Officer at [email protected]. We will promptly investigate your complaint and notify you of the outcome.
